NESTOLOGY TERMS & CONDITIONS

Welcome to Nestology.
These Terms & Conditions (“Terms”) govern your access to and use of the Nestology website, online courses, masterclasses, digital products, downloadable resources, educational materials, memberships, and other services offered by Nestology (“Nestology,” “we,” “us,” or “our”) (collectively, the “Services”).
Please read these Terms carefully before purchasing, accessing, or using any Nestology Service.
By purchasing, registering for, accessing, or using a Nestology Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms presented to you at the time of purchase.
If you do not agree to these Terms, please do not purchase or use our Services.
1. ABOUT NESTOLOGY
Nestology provides general educational and informational content for the public relating to pregnancy, birth preparation, labour, postpartum, breastfeeding, infant feeding, maternal wellness, and related topics.
Our educational content is designed to help individuals become more informed, prepared, and confident.
Nestology does not provide individualized healthcare services through its online courses, masterclasses, digital products, website, or other educational Services.
2. ACCEPTANCE OF TERMS
By registering for, purchasing, accessing, or using any Nestology Service, you agree to these Terms and any other policies or terms incorporated into them.
Certain products or Services may have additional terms presented at the time of purchase. Those additional terms form part of your agreement with Nestology.
These Terms apply to all users of our Services, including purchasers, students, visitors, and other users.
If you purchase or access a Service on behalf of another person or entity, you represent that you have the authority to do so and to bind that person or entity to these Terms.
3. ELIGIBILITY
You represent and warrant that you are at least 16 years of age.
If you are under 16 years of age, you may not access or use the Services unless permitted by applicable law and with the involvement of a parent or legal guardian where required.
Nestology reserves the right to refuse access to any person where permitted by law, including where access or use of a Service would violate applicable laws, regulations, or these Terms.
Our Services are intended for the personal use of the individual who purchases or registers for them and may not be purchased or accessed for the unauthorized benefit of a third party.
4. EDUCATIONAL PURPOSE OF THE SERVICES
Nestology provides general education to the public.
Our content may discuss pregnancy, labour, birth, postpartum recovery, breastfeeding, infant feeding, maternal wellness, physical activity, medical procedures, common healthcare practices, and other health-related topics.
This information is provided for general educational and informational purposes.
The information is intended to help you understand general concepts, prepare questions, understand common options, and have more informed conversations with your own healthcare providers.
It is not intended to provide individualized recommendations based on your personal medical history, symptoms, diagnosis, pregnancy, labour, postpartum circumstances, or your baby's individual health.
5. NURSING AND PROFESSIONAL CREDENTIALS
Some Nestology educational content may be created, narrated, demonstrated, or presented by an individual who is a registered nurse or who has other professional education, training, or credentials.
The use of professional knowledge, education, training, or experience in creating educational content does not mean that Nestology is providing nursing services or individualized nursing care through the Services.
The fact that an instructor or contributor is a registered nurse does not, by itself, create a nurse-patient relationship.
Nestology's educational content is provided to the public in an educational capacity and is not being provided as individualized nursing care.
No assessment, diagnosis, treatment plan, individualized nursing intervention, clinical monitoring, or healthcare-provider relationship is established through your purchase or participation in a Nestology course or other educational Service.
6. MEDICAL AND HEALTHCARE DISCLAIMER
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.
Nestology's courses, masterclasses, videos, written materials, worksheets, templates, demonstrations, guides, checklists, downloads, emails, and other educational content are not individualized medical advice and are not a substitute for professional healthcare.
Nothing provided through the Services is intended to:
diagnose a medical condition;
assess your individual medical circumstances;
provide individualized medical or nursing advice;
prescribe or recommend individualized medical treatment;
provide individualized healthcare instructions;
replace an assessment by a qualified healthcare professional;
replace the advice of your physician, midwife, nurse practitioner, registered nurse, lactation professional, or other qualified healthcare provider; or

Nestology provides general information to the public.

Your pregnancy, labour, birth, postpartum recovery, breastfeeding experience, and your baby's health are unique.
Information that may be appropriate or useful for one person may not be appropriate for another.
You should not disregard, delay, or discontinue medical advice, treatment, medication, monitoring, or recommendations provided by your healthcare professional because of anything you have learned through Nestology.
7. NO INDIVIDUALIZED HEALTHCARE RELATIONSHIP
Your purchase, enrollment, viewing, downloading, or participation in any Nestology Service does not create:
a nurse-patient relationship;
a physician-patient relationship;
a midwife-patient relationship;
a lactation consultant-client relationship;
a therapist-client relationship; or
any other individualized healthcare provider-patient or professional-client relationship.
Questions asked through a course, community, email, comment section, or other Nestology communication channel should not be assumed to create an individualized healthcare relationship.
Nestology may choose to provide general educational information in response to questions, but such information does not constitute individualized medical care.
8. EMERGENCIES AND URGENT MEDICAL CONCERNS
Nestology's Services are not intended to provide emergency medical advice or emergency medical services.
If you or your baby is experiencing an emergency, urgent medical concern, significant complication, or other situation requiring immediate medical attention, contact your healthcare provider, local emergency services, or an appropriate healthcare facility.
Do not delay seeking medical care because of information contained in our Services.
Nestology does not provide emergency assessment, diagnosis, monitoring, or treatment through its online courses or educational materials.
9. PREGNANCY AND BIRTH EDUCATION
Nestology may provide general educational information regarding:
pregnancy;
labour;
birth preparation;
birth preferences;
pain-management options;
fetal monitoring;
induction;
assisted birth;
cesarean birth;
postpartum recovery;
newborn care; and
other pregnancy and birth-related topics.
This information is educational in nature and is not individualized medical advice.
You are encouraged to discuss questions and personal circumstances with your own healthcare provider.
10. BIRTH PLANS
Any birth plan, birth-plan template, worksheet, checklist, or educational material provided by Nestology is intended to help you identify your preferences, prepare for conversations, and communicate with your healthcare team.
A birth plan is a guide and communication tool, not a guarantee, contract, or prediction of how your birth will occur.
Birth circumstances can change unexpectedly.
Medical circumstances, safety considerations, clinical judgment, healthcare-provider recommendations, hospital policies, or the condition of you or your baby may require changes to your preferences.
Nestology does not guarantee that any particular birth preference, intervention, procedure, position, environment, or request will be available, appropriate, or medically advisable in your individual circumstances.
You are responsible for discussing your birth preferences with your healthcare provider and understanding your available options.
11. BREASTFEEDING AND INFANT-FEEDING EDUCATION
Nestology may provide general educational information about:
breastfeeding;
lactation;
latch;
breastfeeding positions;
milk supply;
pumping;
hand expression;
infant feeding;
feeding cues;
supplementation;
formula feeding; and
related topics.
This information is provided for general educational purposes only.
Breastfeeding and infant-feeding circumstances vary between individuals and babies.
If you have concerns about your baby's feeding, hydration, weight gain, milk intake, latch, milk supply, jaundice, illness, development, or general health, seek individualized assessment and guidance from an appropriately qualified healthcare professional.
Nestology does not replace individualized assessment or care from a physician, midwife, nurse practitioner, registered nurse, lactation professional, pediatric healthcare provider, or other qualified professional.
12. PHYSICAL ACTIVITY AND WELLNESS EDUCATION
Some Nestology Services may include general educational information relating to movement, exercise, stretching, breathing techniques, positioning, relaxation techniques, prenatal fitness, postpartum fitness, or other physical practices.
Such content is educational and is not individualized exercise prescription or medical advice.
You are responsible for determining whether participation in any activity is appropriate for your individual circumstances.
Pregnancy and postpartum recovery can involve risks that vary between individuals.
Consult your healthcare provider before beginning or modifying an exercise program or participating in an activity if you have questions or concerns about whether it is appropriate for you.
You should stop an activity and seek appropriate professional advice if you experience concerning symptoms or if your healthcare provider advises you to do so.
13. INDIVIDUAL RESULTS AND NO GUARANTEE
Nestology does not guarantee any particular pregnancy, labour, birth, postpartum, breastfeeding, health, fitness, or other outcome from participating in our Services.
Individual experiences and outcomes vary.
Factors outside of Nestology's control may affect your experience, including:
individual health circumstances;
pregnancy complications;
labour circumstances;
medical recommendations;
birth-facility policies;
medications;
medical interventions;
infant health;
breastfeeding circumstances;
adherence to educational recommendations;
individual preferences; and
other personal or environmental factors.
Testimonials, examples, demonstrations, personal stories, and descriptions of individual experiences are provided for educational purposes and are not guarantees of your results.
14. COURSE CONTENT
For purposes of these Terms, “Content” includes, without limitation:
course videos;
masterclasses;
audio;
photographs;
written materials;
text;
worksheets;
templates;
birth plans;
breastfeeding resources;
checklists;
guides;
graphics;
presentations;
downloadable files;
demonstrations;
recordings;
bonus materials;
website content; and
other materials made available through the Services.
All Content is provided subject to these Terms.
Nestology may update, modify, improve, replace, or revise Content from time to time.
We do not guarantee that every piece of Content, feature, bonus, download, or course component will remain available indefinitely unless expressly stated otherwise at the time of purchase.
15. INTELLECTUAL PROPERTY
Unless otherwise stated, all Content provided by Nestology is owned by or licensed to Nestology and is protected by applicable copyright, trademark, intellectual-property, and other laws.
Your purchase of a course or digital product does not transfer ownership of the underlying intellectual property to you.
Subject to these Terms, Nestology grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable licence to access and use purchased Content solely for your own personal, non-commercial educational purposes.
You may not:
reproduce or copy course Content;
record or screen-record course videos;
redistribute course Content;
upload Content to another website or platform;
share downloadable materials with others;
sell or sublicense Content;
publish Content publicly;
use Content to create another course or educational program;
modify Content for commercial use;
use Content to provide services to clients or customers without written authorization; or
otherwise commercially exploit Content without prior written permission from Nestology.
You may not remove or alter copyright, trademark, attribution, or other proprietary notices contained in the Content.
16. PERSONAL USE AND COURSE ACCESS
A course purchase provides access to the individual purchaser only.
You may not share your course access, account, password, or other login credentials with another person.
You may not purchase a course for the purpose of allowing multiple people to access it unless Nestology has expressly authorized such use.
If Nestology determines that an account is being shared, resold, redistributed, or otherwise misused, we reserve the right to suspend or terminate access, subject to applicable law.
Where “lifetime access” is offered, it means access for as long as Nestology continues to make that course available on its platform. Lifetime access does not guarantee that a course, platform, technology, or individual piece of Content will remain available indefinitely.
17. DIGITAL DOWNLOADS
Digital downloads, templates, worksheets, guides, checklists, PDFs, and other downloadable products are licensed to the purchaser for personal use only.
You may print materials for your own personal use where technically permitted.
You may not distribute, reproduce, resell, publish, upload, or commercially exploit digital materials without written permission from Nestology.
18. PAYMENTS AND BILLING
Certain Services require payment.
Prices, payment terms, payment schedules, taxes, and other purchase information will be displayed at or before checkout.
By purchasing a paid Service, you agree to pay the applicable price using the payment method selected at checkout.
Payments may be processed through a third-party payment processor.
Payment processing may be subject to the payment processor's own terms and privacy policies.
Nestology is not responsible for errors or failures caused solely by a third-party payment processor.
You agree to provide accurate and current billing information.
If a payment fails, Nestology may suspend access to the applicable Service until payment is successfully received, subject to applicable law.
19. PAYMENT PLANS AND SUBSCRIPTIONS
Where Nestology offers a payment plan, the total payment obligation and applicable payment schedule will be displayed at checkout.
By selecting a payment plan, you agree to make the scheduled payments according to the terms presented at the time of purchase, subject to applicable refund and cancellation rights.
Where Nestology offers subscriptions or recurring payments, the applicable recurring charge, billing frequency, and cancellation terms will be disclosed before purchase.
You are responsible for cancelling recurring subscriptions in accordance with the applicable cancellation instructions.
Nothing in this section limits any statutory cancellation or consumer rights that apply to you.
20. REFUND POLICY
Nestology offers a 30-day refund period for eligible course purchases.
To request a refund, contact Nestology within 30 days of the original purchase and provide sufficient information for us to identify the transaction.
Where a refund is approved, the applicable course or product access may be cancelled or removed.
Unless otherwise stated at the time of purchase, refunds will be returned using the original payment method where reasonably possible.
Nothing in this refund policy is intended to exclude, restrict, or waive any consumer rights or cancellation rights that cannot legally be excluded or waived under applicable law.
Applicable consumer-protection legislation may provide additional cancellation or refund rights in certain circumstances.
21. INTERNET AND ONLINE SALES
For online purchases, Nestology will provide the information required by applicable consumer-protection legislation before or at the time of purchase.
Where required by law, customers will be provided with an express opportunity to accept or decline the transaction and to review and correct errors immediately before completing the purchase.
Where required by applicable law, Nestology will provide a copy of the internet sales contract electronically.
Nothing in these Terms limits any cancellation, refund, disclosure, or other statutory rights available to consumers under applicable law.
22. THIRD-PARTY SERVICES AND PLATFORMS
Nestology may use third-party services and platforms to host courses, process payments, deliver email communications, provide digital downloads, provide analytics, or otherwise facilitate the Services.
These may include course-hosting platforms, payment processors, email providers, website providers, analytics services, and other technology providers.
Your use of third-party services may be subject to those providers' own terms and privacy policies.
Nestology does not control third-party services and is not responsible for their independent acts, omissions, policies, availability, security, or performance.
23. THIRD-PARTY LINKS AND RESOURCES
The Services may contain links to websites, resources, products, or services operated by third parties.
Third-party websites are not controlled by Nestology.
You access third-party websites and resources at your own risk.
Nestology is not responsible for the accuracy, legality, availability, privacy practices, content, products, services, or other aspects of third-party websites.
The inclusion of a link does not necessarily constitute an endorsement or recommendation by Nestology.
24. RULES OF CONDUCT
As a condition of using the Services, you agree not to use the Services for any unlawful, fraudulent, abusive, or prohibited purpose.
You must not:
violate any applicable law or regulation;
infringe another person's intellectual-property rights;
impersonate another person or entity;
provide knowingly false or misleading information;
harass, threaten, abuse, or defame others;
engage in fraudulent activity;
interfere with the operation of the website or course platform;
introduce malicious software, viruses, or harmful code;
attempt to gain unauthorized access to accounts, systems, or networks;
scrape, harvest, or systematically copy Content;
circumvent access controls or security measures;
use the Services for unauthorized advertising or spam; or
otherwise interfere with the rights, safety, or operation of Nestology, its users, or third parties.
Nestology reserves the right to take reasonable action where necessary to protect the Services, users, and our business.
25. ACCOUNT SUSPENSION OR TERMINATION
Nestology may suspend or terminate your access to the Services if you materially violate these Terms, engage in unauthorized use, share account credentials, infringe intellectual property rights, engage in fraudulent activity, or otherwise misuse the Services.
Where appropriate and reasonably possible, Nestology may provide notice and an opportunity to correct the violation.
Termination does not eliminate obligations that by their nature should continue after termination, including intellectual-property restrictions, disclaimers, limitations of liability, indemnification obligations, and dispute provisions.
26. PRIVACY AND PERSONAL INFORMATION
Nestology may collect and use personal information in connection with your purchase and use of the Services.
Our collection, use, disclosure, storage, and protection of personal information are governed by our Privacy Policy, which forms part of these Terms.
Nestology will handle personal information in accordance with applicable privacy laws.
We will take reasonable measures appropriate to the sensitivity of the information to protect personal information under our control.
You should review our Privacy Policy before purchasing or using our Services.
If you provide information through a third-party platform, that platform's privacy practices may also apply.
27. COMMUNICATIONS AND MARKETING
If you voluntarily provide your email address or other contact information, Nestology may use it to provide transactional communications relating to purchases, accounts, courses, updates, customer support, and other Services.
Where required by law, marketing communications will be sent only with the appropriate consent and will include an appropriate unsubscribe mechanism.
You may unsubscribe from marketing communications at any time, subject to applicable law and except for communications necessary to administer your account, purchase, or transaction.
28. USER CONTENT AND SUBMISSIONS
If a Service permits you to submit comments, questions, testimonials, photographs, reviews, or other content (“User Content”), you are responsible for ensuring that your User Content is accurate and does not violate another person's rights.
You must not submit content that is unlawful, threatening, abusive, defamatory, fraudulent, invasive of privacy, obscene, or otherwise prohibited by these Terms.
You retain ownership of your User Content.
By submitting User Content to an area where you have expressly agreed that it may be shared publicly, you grant Nestology the rights reasonably necessary to display and administer that User Content.
Nestology will not use private health information or other sensitive personal information for marketing purposes without appropriate authorization or legal basis.
29. NO WARRANTIES
To the maximum extent permitted by applicable law, the Services and Content are provided on an “as available” and “as is” basis.
Nestology does not guarantee that:
the website or course platform will always be available;
the Services will be uninterrupted or error-free;
every technical defect will be corrected;
all Content will remain available;
the Services will meet every individual's expectations; or
participation in a course will produce a particular result.
Nothing in these Terms excludes or limits any warranty, guarantee, or consumer right that cannot legally be excluded or limited under applicable law.
30. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Nestology, its owners, directors, employees, contractors, instructors, representatives, suppliers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.
This includes, to the extent permitted by law, loss of profits, loss of data, business interruption, or other indirect losses.
To the maximum extent permitted by applicable law, Nestology's aggregate liability arising from a particular purchase or Service will not exceed the amount you actually paid to Nestology for that particular Service during the three months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot legally be waived or limited.
31. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Nestology and its owners, directors, employees, contractors, instructors, representatives, suppliers, affiliates, and service providers from claims, liabilities, losses, damages, costs, and reasonable expenses arising from:
your violation of these Terms;
your misuse of the Services;
your unauthorized use or distribution of Content;
your violation of another person's rights; or
your unlawful or unauthorized conduct in connection with the Services.
This provision does not apply to the extent that a claim results from Nestology's own negligence, wilful misconduct, or other conduct for which liability cannot legally be shifted.
32. DISPUTE RESOLUTION
We encourage you to contact Nestology first to attempt to resolve any concern or dispute informally.
Nothing in these Terms prevents you from exercising any statutory consumer-protection, cancellation, privacy, or other legal rights that cannot legally be waived.
Subject to applicable law, these Terms and any dispute arising from them will be governed by the laws applicable in the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Where a dispute cannot be resolved informally, the parties will have access to the courts and dispute-resolution processes available under applicable law.
Nothing in this section requires a consumer to waive a statutory right to bring a claim in a court or forum where applicable law permits or requires that claim to be brought.
33. GOVERNING LAW AND JURISDICTION
Subject to any mandatory consumer-protection or other applicable law that provides otherwise, these Terms are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada.
Where permitted by law, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of New Brunswick.
34. CHANGES TO THESE TERMS
Nestology may modify these Terms from time to time.
When we make material changes, we may provide notice by posting updated Terms on our website, updating the effective date, sending an email, or using another reasonable method of communication.
Your continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
Changes will not retroactively eliminate rights that you have already acquired under applicable law.
35. COURSE AND SERVICE AVAILABILITY
Nestology reserves the right to modify, suspend, replace, or discontinue any course, product, feature, platform, or Service.
Where reasonably possible, Nestology may provide notice of material changes affecting purchased Services.
Nestology will not be responsible for interruptions caused by circumstances beyond its reasonable control, including technical failures, internet disruptions, platform outages, natural disasters, government action, labour disruptions, or other events beyond reasonable control.
36. FORCE MAJEURE
Nestology will not be liable for a failure or delay in performing an obligation under these Terms where the failure or delay results from circumstances beyond our reasonable control.
37. ASSIGNMENT
These Terms are personal to you and may not be assigned, transferred, or sublicensed by you without Nestology's prior written consent.
Nestology may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, or other business transaction, subject to applicable law.
38. NO AGENCY OR PARTNERSHIP
Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, or other legal relationship between you and Nestology beyond the contractual relationship expressly described in these Terms.
39. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, where legally permitted.
The remaining provisions will continue in full force and effect.
40. NO WAIVER
Nestology's failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.
41. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, applicable purchase terms, and any additional terms expressly incorporated into a particular Service, constitute the agreement between you and Nestology regarding your use and purchase of the Services.
They supersede prior agreements, representations, or communications concerning the same subject matter, except where applicable law provides otherwise.

Section headings are provided for convenience only and do not affect the interpretation of these Terms.

ONE-ON-ONE PROFESSIONAL SERVICES
Nestology may offer one-on-one services involving kinesiology, movement, exercise, physical activity, prenatal and postpartum fitness, wellness education, and related services (“One-on-One Services”).
These services are distinct from Nestology's general educational courses and digital products.
Where a One-on-One Service is provided in a kinesiology capacity, the service is intended to be provided within the provider's education, training, competence, professional standards, and applicable requirements.
Before participating in One-on-One Services, clients are responsible for providing accurate and complete information relevant to their participation, including information regarding pregnancy, postpartum status, injuries, medical conditions, medications, symptoms, physical limitations, and restrictions that may reasonably affect participation.
Clients agree to notify Nestology of any change in their health or circumstances that may affect their ability to safely participate.
Clients are responsible for obtaining medical clearance or professional advice where appropriate before beginning or modifying physical activity.
And:
Nestology reserves the right to modify, postpone, or decline a service where the provider reasonably believes that the service is outside the provider's competence, outside the scope of the service purchased, or may not be appropriate without additional assessment or clearance from another healthcare professional.
